General court of the European Union ruled in favor of fast food chains McDonald's in a dispute over trademark MacCoffee with Singaporean company Future Enterprises. McDonald's claimed that it has the exclusive right to use the prefix «Mc» or «Mac» in the trademark for food and beverages. According to the court, the word «MacCoffee» and «McDonald's» were recognized phonetically similar.
In this connection, the court found that the presence in the beverage designation of prefix «Mac» can lead to confusion of Future Enterprises and McDonald's products. As a result, the court upheld the Intellectual Property Office of the European Union decision which had previously refused the trademark registration to Singapore company.
